Terms & Conditions of use

The piasa.fr website is intended to present the activities of the PIASA company, and in particular  to enable users to view and purchase lots from the various auctions it organizes. 

The following are the terms and conditions of use (the “Terms”) under which you (a “User”) may  use the piasa.fr website (the “Site”). By accessing and using the website, you agree to be bound,  without modification, limitation or qualification, by these Terms. Piasa may, at its sole  discretion, and without prior notice, modify or revise the Terms by updating this legal notice and  any material presented on the Site. You are bound by any such modifications and should  therefore visit this page regularly to review the terms and conditions of use. 

The use of certain Site services may be subject to additional terms and conditions. For  example, when the User places a purchase order or takes part in an online sale, this action  will be subject to the General Terms and Conditions of the concerned sale. 

Section 1 : Protection of personal data

Our privacy policy for the User's personal information is determined in the “GDPR” section of the  Site. 

PIASA respects the law "informatique et libertés" n° 78-17 of January 6, 1978 modified by the law  n° 2024-449 of 21 May 2024 integrating in French law the Directive (UE) 2016/680 of April 27  2016 on the protection of personal data and privacy within the European Union and the law on "  confidence in the digital economy " n° 2004-575 of June 21, 2004 (article L. 33-4-1 amended of  the French Post and Telecommunications Code and Article L. 121-20-5 new of the French  Consumer Code) incorporating into French law Directive 2000/31/EC of June 8, 2000 on  electronic commerce and Directive 2002/58/EC of July 12, 2002 on the protection of personal  data and privacy in electronic communications.

Section 2 : Intellectual property

Respect of the intellectual property 

As part of the presentation of lots for sale, PIASA may display on its website illustrations,  reproductions and quotations of original works protected by copyright and/or by legislation  relating to designs and models and/or by trademark legislation. 

Unless otherwise stated, any reproduction, representation, use, adaptation, modification,  incorporation, translation, marketing, in part or in full, by any process and on any medium  whatsoever, is strictly forbidden, except for the exceptions set out in article 122-5 of the  Intellectual Property Code and constitutes an infringement of copyright punishable under the  provisions of Book III of the Intellectual Property Code.  

The sale of a work through the PIASA website does not imply the transfer of reproduction and  representation rights of the work. 

Piasa respects the intellectual property rights of third parties. If you believe that your creation is  subject to copyright infringement, please send your complaint to juridique@piasa.fr. 

Reproduction of the website 

The reproduction of all or part of this site, on any medium whatsoever, is strictly forbidden  without the express authorization of PIASA, and would constitute an infringement punishable by  articles L.335-2 et seq. of the Intellectual Property Code. 

Hypertext link 

The creation of a hypertext link to the Site does not require prior written authorization from PIASA  SA. Nevertheless, PIASA must be informed within a maximum of 30 days after the link is set up. 

In any event, PIASA shall not be held responsible for the content, products or services oAered on  sites to which the Site is linked by hypertext links or any other type of link. 

Brands and logos 

The trademarks, logos and domain names displayed on the Site and all related rights belong to  PIASA or its service providers. Any reproduction or imitation of the PIASA trademark or that of  one of its service providers without the express authorization of the owner of the trademark in 

question is strictly prohibited and constitutes an infringement of copyright under the provisions  of Book VII of the French Intellectual Property Code. 

Section 3: Use 

Use and transfer 

Certain services of the piasa.fr website, in particular online purchase orders and online  purchasing, are reserved for registered Users. 

To become a User, all mandatory fields on the registration form must be completed. If the User is  an individual, he/she declares that he/she is of legal age and has full legal capacity to enter commitments under these conditions. 

When the User fills in the registration form, he/she undertakes to fill it in correctly, and to provide  only accurate, up-to-date and complete information, and to make any necessary updates. 

Use of the User account is strictly personal. 

Any loss, misappropriation or unauthorized use of a User's Identifiers and their consequences  are the sole responsibility of that User. 

Prohibited use 

When using the Site, the User undertakes not to:  

  • Impersonate others 

  • Collect personal information about others (surname, first name, address, telephone  number, e-mail address, bank details) 

  • Insert promotional content or use content from the Site for commercial and/or  promotional purposes. 

  • Extract data using automatic information gathering methods 

  • Engage in any fraudulent activity (money laundering, auction rigging, price fixing) - Engage in any activity that could damage, overburden or impair the functionality of the  Site. For example, by deploying virus software or computer code intended for that  purpose. 

Termination 

Users may cancel their subscription to the Site at any time by sending an e-mail to  digital@piasa.fr. 

The User may, at any time, request to receive or no longer receive the PIASA newsletter to which  he/she has subscribed via the piasa.fr website. 

PIASA reserves the right to terminate a user’s registration and/or block future use of its  services at its sole discretion and without prior notice. 

Section 4 : Liability and disputes

Limitation of liability

PIASA makes every eAort to ensure to the best of its ability the accuracy and updating of the  information published on this site. Nevertheless, the User acknowledges that PIASA cannot  guarantee the accuracy or completeness of the information made available on this site. 

Moreover, PIASA declines all responsibility for any interruption of the site, malfunction or  impossibility of access to the site due to a maintenance operation, for any inaccuracy or  omission concerning the information available on the site, for any damage resulting from a  fraudulent intrusion by a third party leading to a modification of the information made available  on the site. 

Likewise, PIASA shall not be liable for any direct or indirect damage, whatever the cause, origin,  nature or consequences, including costs that may arise from the acquisition of goods oAered on  the site, loss of profits, customers, data or any other loss of intangible assets that may arise  from anyone's access to the site or inability to access it. 

The illustrations and descriptions published on the site have no contractual value and are  subject to change until the actual sale of the lot(s). 

In addition, all items downloaded from the Site are done so at the User's own risk and at the  User's sole discretion. The User shall be solely liable for any damage resulting therefrom. 

Applicable law and jurisdiction 

The piasa.fr website and the present General Terms of Use are translated from French, must be  interpreted in the sense of French law and are subject to French law. 

Any dispute relating to the interpretation or application of these General Terms of Use shall be  brought before the French courts, competent in the jurisdiction of PIASA's registered oAice. 

If any provision of these Terms of Use is found by a court of competent jurisdiction to be invalid,  the remaining provisions of these Terms of Use shall remain in full force and eAect.
